Starting from today, September 1, 2006 the Law on Free Access to Information of Public Character enters into force. The Law should provide publicity and transparency of the work of holders of information, as well as to allow physical and legal entities to enjoy the right to free access to information, MIA reports.

The Law on Free Access to Public Information has been adopted by the Macedonian Assembly on January 25, 2006 and it regulates the terms, way and procedure for enjoining the right to free access to information that are in possession of state bodies, municipalities and public budget enterprises and legal and physical entities.

Holders of information of public character are obliged to provide the public access to the regulations, strategies and other documents within their scope of work, as well as the way they should do that. Each holder of information of public character should entitle an employee for handling such information.

According to the Law, each physical or legal entity can request access to information of public character. The request can be in written or oral. Holder of information is obliged to provide answer immediately, or within 30 days from the request being submitted. The final date for providing information can be prolonged in some cases, but no longer than 40 days. If the requestor is not satisfied with the answer he can lodge a complaint to the Commission for Protection of the Right to Free Access to Information of Public Character within eight days.

Request for free access to information of public character can be refused if the information is classified with a certain level of secrecy, if it is personal data and the disclosure would mean breaching the personal data protection, if it is confidential information or breaches confidentiality of tax process, if it refers to commercial and other economic interests, if its disclosure is harmful for the environment…
 
Fees ranging from 20.000 denars to 50.000 denars are predicted for breaching the Law.
