Reacting to the accusations issued by NGO Internet Macedonia, the Agency for Electronic Communications issued the following public announcement.
Reacting to the accusations issued by NGO Internet Macedonia, the Agency for Electronic Communications issued the following public announcement. Following the announcement of so called Association for better internet whose extracts were published in certain newspapers the last days, the Agency for Electronic Communications would like to express its attitude with the aim to inform the public in more precisely and adequate manner about the internet technologies and the role of the Agency in that domain.
Namely, the internet access to the end-users in the Republic of Macedonia is providing in certain ways via: - ADSL, - Cable access, - WiFi (wireless access), - Satellite, GPRS connections (via mobile telephones) - Dial-up modem links. - In the Republic of Macedonia there is a great number of internet providers that practicaly indicate that this market is completely liberalised. In addition, the prices are market oriented ( there is no legal possibility the regulator to create the prices, it should not be such a case). It is logical the lower price to result with the lower quality of the service and vice versa.
The number portability is a service giving the right to the subscriber to retain the existing subscriber calling number (geographic number in the fixed telephony and non-geographic number in the mobile telephony). In both type of a network (fixed and mobile) it is related to the service - PUBLIC TELEPHONE SERVICE – not to the data transmittion - internet service.
The new operators and service providers appeared by the Electronic Communications Law are primerily oriented towards providing the outcoming calls for telephone subscribers of the existing operators via different technology (green number for VoIP providers, carrier selection and pre-selection ).
The new operators are in a stage of lacking an access to the end-users still and offering local and national calls that is relevant to the number portability.
In regard of the bylaws reffering to the liberalisation of the internet services, the Agency for Electronic Communications has enacted all bylaws concerning the internet services. The most important bylaw relating to the unbandled access to local loop, MATERUO, was enacted in April 2006. These Rules enable, under exact determined conditions and prices, to the new operator to use the same twisted cooper wires of the user owned by the Makedonski Telekomunikacii, aiming at the new operator to provide xDSL internet access or both telephony and xDSL internet access (e.g. ADSL).
Thereat, the benchmarking method was used for the prices in the RUO and in such way lower prices were riched for sharing the twisted cooper wires by more of the countries in the Region (completely - for telephony and ADSL via new operator or partially - only for xDSL for a new operator).
In regard of the ADSL users appeals concerning the penalties due to the breching of the agreements with the Makedonski Teklekomunikacii, at the joint meeting held between the AEC and Association of the ADSL users the minutes of performed supervision by the inspector were presented, all details were clarified and the same were accepted by both parties.
Finally, the connection of the RIO ( Referent Interconnection Offer) that is relating only to the fixed and mobile telephony with the internet services, as it was stated in the Announcement of the Association is extremely unappropriate.
Due to the unspeciality of the Association staff and unknowing of the manner and operation of the internet technologies, as well as appropriate regulations regarding the same, the Agency for Electronic Communications is open for further cooperation for clarification the above issues.
